On 02.05.2024, the EU Official Journal published REGULATION 2024/1258 amending REGULATION 561/2006, which will come into effect on 22.05.2024.
The following key changes are made:
1. Change to the Break Rule during Driving in Occasional Passenger Transport
For drivers performing occasional passenger transport, the 45-minute break taken no later than after 4.5 hours of continuous driving can now be replaced by two breaks, each lasting at least 15 minutes, and they must be taken during the 4.5-hour driving period.
2. Change to the Daily Rest Rule for Drivers Performing One-Off Occasional Passenger Transport
A driver performing one-off occasional passenger transport for at least six consecutive 24-hour periods may take the daily rest within a maximum of 25 hours after completing the previous daily rest or weekly rest, provided that the total accumulated driving time for that day does not exceed seven hours. This exemption can be used twice within one-off occasional passenger transport lasting at least eight consecutive 24-hour periods. The application of this exemption does not affect the maximum duration of working hours.
3. Change to the Weekly Rest Rule for Drivers Performing One-Off Occasional Passenger Transport
The already established rule for taking the weekly rest after twelve 24-hour periods in international occasional passenger transport now applies also to domestic occasional passenger transport.
ATTENTION!
For roadside checks, until the digital travel log becomes available, the driver must be able to justify the application of the exemption by:
Having a completed travel log in the vehicle, which contains the information required by Regulation (EC) No. 1073/2009 and which the carrier must provide to the driver before each journey.
Having paper or electronic copies of such travel logs for the previous 28 days, and from 31 December 2024, for the previous 56 days.
