OBLIGATIONS OF THE COMPANY

Obligations of carriers related to tahograph data

  • The employer is required to organize the work of drivers in such a way that drivers comply with legal provisions, inform them about the regulations, and perform regular checks while keeping records of drivers’ working hours. The employer must ensure that their drivers are familiar with the regulations concerning working hours, rest periods, and proper use of the tachograph.
  • The employer must possess a company card for digital/smart tachographs in order to lock the data on their tachographs (Legal obligation) and use it to retrieve tachograph data. The locking must be done before the first commercial trip.
  • Ensure the retrieval of data from the driver’s card and tachograph within legal frameworks.
  • Reading the driver’s card – no more than 28 days should pass between two readings.
  • Reading the tachograph (unit in the vehicle) – no more than 90 days should pass between two readings.

Data must be regularly stored in SOTAH (with the same legal intervals as they are retrieved).

The records must be kept for at least 3 years.
