OBLIGATIONS OF THE COMPANY

Permits and licenses

A carrier engaged in the public transport of goods and/or passengers must have a Community License if performing international transport (issued by the Ministry of the Sea, Transport, and Infrastructure) or a Domestic Transport License if performing domestic transport within Croatia (issued by the competent State Administration Office based on the carrier’s seat).

Carriers holding a Community License can use it for domestic transport as well and are not required to obtain a separate Domestic Transport License.

A carrier performing transport for its own needs (goods and/or passengers) must have a Transport for Own Needs Registration, which is issued by the competent State Administration Office based on the carrier’s seat.

A carrier performing public transport or transport for its own needs using vehicles that require a driving license of category C1, C1E, C, or CE, or category D1, D1E, D, or DE, can only employ drivers who are professionally trained through initial qualification and periodic training, or who hold CODE 95 certification.

Vehicles used for public road transport and transport for own needs must, in addition to meeting other regulations governing road safety and vehicle registration, comply with special conditions concerning appearance, age, devices, and equipment of the vehicles, as specified in the Road Transport Act and the Regulation on Special Conditions for Vehicles Used for Public Transport and Transport for Own Needs.

When carrying out public transport of goods and/or passengers, carriers and their drivers must comply with the laws regulating road transport, working hours of mobile workers, and the use of tachographs, as well as laws regulating road safety and their related subordinate regulations.

Licenses for road transportation of goods and passengers

In order to hold a license for the public transportation of goods and/or passengers, the carrier must have a good reputation, financial capacity, a transport manager, a business address in the Republic of Croatia, technical capability, and must not have outstanding tax obligations or obligations for pension and health insurance.

The license is issued for a period of ten years, the license and its extracts for vehicles are non-transferable, and the application for license renewal must be submitted at least two months before its expiration.

A carrier who ceases to perform transportation activities is required to notify the license issuer within eight days from the cessation of activities.

The original license is kept at the headquarters of the domestic carrier.

When performing road transport, or during driving, the carrier’s driver must have an extract from the Domestic Transport License or a certified true copy of the Community License for international transport in the vehicle.

The carrier is obliged to notify the license issuer of any change in the data on which the license was issued, within eight days of the change, either in writing or electronically

The transport manager is a natural person employed in a legal entity or a business, or an individual entrepreneur, or another person who, based on a specific contract, actually and permanently manages the transport activities of the legal entity or business, based on professional qualifications obtained by passing an exam for professional qualifications for performing public road transport activities in the Croatian Chamber of Crafts or Commerce, or based on higher or university education in the field of transport.
